This Privacy Policy sets out how ASM uses Personal Data of our (potential) clients and suppliers and visitors of our website when using our website, when accessing one of our online portals or tools, when using our services, when purchasing our products or when interacting with us (jointly referred to as “Services”).

For purposes of this Privacy Policy, "Personal Data" means any information through which we can identify an individual, as further described below under paragraph “What information is collected”. This Privacy Policy does not apply to corporate company information if no Personal Data from individuals can be derived from such corporate information.

ASM” means for the internet website www.asm.com ASM International N.V. or in case of using the supplier portal the ASM company that you entered into a contract with, and which are responsible for using your Personal Data.

For the purposes of applicable European data protection legislation, ASM International N.V., Versterkerstraat 8, 1322 AP, Almere, The Netherlands is the representative company for non-EU ASM entities and shall serve as point of contact for EU data subjects and Data Protection Authorities.

WHAT INFORMATION IS COLLECTED

The types of Personal Data we collect and process and the legal bases are described in this chapter. ​

Suppliers when using our Supplier Portal 

​When we are doing business with our (corporate) suppliers (business-to-business), the Personal Data we collect concerns the data that relates to our suppliers and their representatives / contact persons. 

When you use our Services, we will collect the following Personal Data:

  • Your contact details. Your name, address and any other contact details you provide to us, such as your telephone number and e-mail address.
  • Log-in details. Your username and password when using our Website or our online portals and tools
  • Your use of our Services. We collect information relating to your use of Services, such as information related to sales you make (on behalf of the company you work for).
  • Your financial details. The financial information that has been disclosed to us (either upon request or voluntarily) and can be linked to you as a supplier (representative), such as bank account details or invoicing details.
  • Your communication data. Your requests, any complaints on behalf of your company you may have and any other data that we receive if we communicate with you via email or online.
  • Recording of video footage. When you enter or buildings or premises, you may be recorded by our video surveillance systems (CCTV).
  • Any other Personal Data. This includes any Personal Data that you disclose to us during the course of your contractual relationship with us, either voluntarily or upon request.

Website visitors/users online portals and tools 

When you visit our Website or use our online portals or tools, ASM may collect information about your use of our Website, online portals or tools that will help ASM improve its online services (for example, the pages you access on our sites, the name of your Internet Service Provider, the site that referred you to the Website, what browser you are using, your IP address, etc.). This information may be used to analyze trends and statistics and monitor link usage. 

If you choose to post messages in message areas or to provide feedback or send an email to us, we may keep a record of that posting or correspondence. Information you disclose in a public message area will naturally be available to and shared with other users of our Website. ASM will only use your Personal Data in the ways specified when it was collected. We will not subsequently change the way in which we use your Personal Data, unless such is permitted by law.

HOW WE USE INFORMATION

ASM will use the Personal Data you provide to us for the following purposes and on the following legal bases.


  • To provide information about products or Services you have shown interest in;
  • To deliver the products or perform the Services you requested for.

Our lawful basis for processing your Personal Data for these purposes are to fulfill a contract we have with you or because you asked us to do something as a first step before entering into a contract. 


  • To answer any of your inquiries or requests. In this case, our legitimate interests consist of ensuring that we communicate with you in a timely manner and answer your requests cost-effectively;
  • To make sure that our website is functioning properly for you and your device and to improve the security of our website and networks. In this case our legitimate interests consist of ensuring that you receive an excellent user experience and that our networks are secure; 
  • To generate statistics on the use of our Website and to analyze and improve its use and functionality. In this case our legitimate interests consist of analyzing the use of our website with help from statistics so that we can optimize the attractiveness, content, and functionality of the information we provide on it;
  • To protect our assets, premises and employees.

Our lawful basis for processing your Personal Data for these purposes is that the processing is necessary for the purposes of the legitimate interests pursued by us. 


  • To monitor and ensure compliance with applicable laws and regulatory requirements to which we are subject, such as in relation to the retention of records or trade sanctions.

Our lawful basis for processing your Personal Data for this purpose is that we are compelled to comply with a legal obligation. 

  • To enable our website to remember that you have consented to the placement of cookies on your computer or device in accordance with our Cookie Policy.

Our lawful basis for processing your Personal Data for this purpose is that you have given us your consent.


We may also use your Personal Data for our own marketing purposes. 

Where necessary we use your Personal Data to comply with applicable laws and regulations; investigate or prevent illegal activities, suspected fraud, violations of our terms and conditions, or threats to the property or safety of any person; and protect our legal rights or defend against legal claims.​

SHARING INFORMATION

We may share your Personal Data within our group of companies (see for an overview of our group companies the Annual Report on our website) and receive data from these companies for the purposes described in this privacy Policy. 

We may also share your Personal Data with trusted third parties that perform business functions (e.g. hosting of our websites) or provide services on our behalf (e.g. support services). Consistent with applicable legal requirements, we take commercially reasonable steps to require third parties to adequately safeguard your Personal Data and only process it in accordance with our instructions.


We may also disclose your Personal Data if disclosure is required by law; to investigate or prevent illegal activities, suspected fraud, violations of our terms and conditions, or threats to the property or safety of any person; or to protect our legal rights or defend against legal claims.


Please be informed that ASM may transfer and process any Personal Data you provide to us to countries other than your country of residence. The laws of these countries may not afford the same level of protection to your Personal Data. ASM will therefore seek to ensure that all adequate safeguards are in place and that all applicable laws and regulations are complied with in connection with such transfer. With respect to the intra-group transfers of your Personal Data, ASM has in place an intra-group data transfer agreement in accordance with applicable laws, which provides for measures to ensure an adequate protection of your Personal Data.

DATA SECURITY

ASM uses industry standard efforts to safeguard the confidentiality of your Personal Data. We have taken taken technical, physical and organizational measures in order to protect Application Data in its custody or control from loss, theft, misuse, unauthorized access, disclosure, alteration, copying, accidental or unlawful destruction and any other unlawful forms of using.   

​Access to your Personal Data is limited to ASM employees and authorized third party agents who need it to do their job. Unfortunately, it is impossible to absolutely guarantee the security of data transmission over the Internet or any wireless network. Therefore, although we take reasonable measures to protect your information, ASM cannot ensure the security of any information you transmit to us or from online services and you do so at your own risk. Once we receive your transmission, we will use industry standard efforts to ensure its security on our systems.

DATA RETENTION

ASM will store your Personal Data for as long as it is necessary to fulfill the purposes we collected it for, unless there is a legal, accounting or reporting requirement to retain your Personal Data for a longer period (in which case we will store the Personal Data for as long as required to fulfill such legal, accounting or reporting requirement).

You have several rights in relation to the Personal Data processed by ASM. For example you have the right to request, review, correct, update, restrict or delete Personal Data you have provided to us. If you want to exercise your rights, you can contact us by sending an email to privacy@asm.com. We will respond to your request consistent with applicable law. 

In your request, please tell us what Personal Data you would like to have changed, whether you would like to have it removed from our database, or let us know what limitations you would like to put on our use of it. We will comply with your request as soon as reasonably practicable. Please note that we may need to retain certain Personal Data for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion.


In the event your Personal Data are processed on the basis of your consent, you can withdraw consent at any time by sending an email to privacy@asm.com. Please note that a withdrawal of consent does not affect the lawfulness of any processing which has taken place before the consent was withdrawn.​
